Conditions of Use

Must Read for the purchaser of PIXDISC PRO movies.

Please read carefully this Conditions of Use in advance, and without omission a purchaser must understand and agree on the Conditions of Use of PIXDISC PRO movies. Please be forewarned.

Conditions of Use

All our products are royalty free, unless your use of our product does not violate the terms and conditions stated on the section of "General Conditions of Use" mentioned below. If your use of PIXDISC PRO movies is clear that it is not violating the terms and the conditions, you can use them for TV broadcasting, CM, promotion videos and etc. as many times as you like.

Please note that once you purchase any products on PIXDISC PRO site, automatically we consider that you have agreed with the point that the purchaser is not going to violate "General Conditions of Use" stated below.  So, automatically it is a royalty free contract. Also it is basically no return and no refund.

If anyone who wishes having a contract, which has different, content from "General Conditions of Use" mentioned below, please contact to info@pixelcraft.co.jp for your further inquiry and Individual Contract.

General Conditions of Use

License to use

The copyrights of all motion graphics materials in this product (software) remain at all times the property of creators.  Pixelcraft co. has all the licensing of PIXDISC PRO movies. Therefore Pixelcraft co. permits the use of these motion graphics materials to only the official registered purchasers.

Prohibited actions

The Pixelcraft co. has the authority to ban your use of the materials whenever you have done the following prohibited actions or anything considered being the one, even though you are one of registered purchasers who is officially having the license to use the materials (PIXDISC PRO movies).

• Any actions considered to be disadvantage of the sales of PIXDISC PRO movies.

  Either for commercial or noncommercial purpose, selling the materials' duplicate or their part separately, renting, distributing, releasing on the internet, or all other actions which are considered to be disadvantage of the sales of PIXDISC PRO movies.

• The Use of PIXDISC PRO movies for the purpose of marketing

  When the whole materials (PIXDISC PRO movies) or parts of them consisting any products for sale, here PIXDISC PRO movies General Conditions of Use prohibits cases and the examples as follows.

  Examples of prohibited use	Examples of Specific prohibited cases
  Used in any kind of video packages (VHS, DVD, CD-ROM, etc.) for sale.	Used in making visuals for personal weddings or funerals for sale.  Used in packaging for sale, which is movies, visuals and so on originally made for an artist's promotion which was not for sale.
  Selling as a collection of motion graphics materials	Converted from or used the part of PIXDISC PRO movies to be sold as a new collection of motion graphics materials.
  Used as the contents for download sales	Used for the download service for cell phones.
  Used as a part or pertaining visuals of game software or software for PC	Used as a part of background of video or computer games' openings.
  Preinstalled in a variety of hardware for sale	Used as a built-in visual wallpaper for cell phones for sale. Used as navigation pictures for office or AV equipments for sale.

• Using PIXDISC PRO movies on the Internet

  Either commercially or non-commercially, on the Internet it is prohibited to use and show PIXDISC PRO movies in either forms of motion graphics or still images, which captured or copied from PIXDISC PRO movies, to any audience.

  Showing on myspace and other Social network service:
  In addition, it is not permitted showing a mix which contains PIXDISC PRO movies, as one of your mix work on myspace and other Social network service, since the copy right of the motion graphic belongs to each artists, and it is the same to PIXmix.

• Using PIXDISC PRO movies on any printed matters

  It is prohibited to use any part of PIXDISC PRO movies in any printed matters either commercially or non-commercially, such as posters, calendars, greeting cards and other novelties.
  However, it is permitted for a case, in which PIXDISC PRO movies are used in magazine with the articles introducing PIXDISC PRO movies.

• Other ways of use stated below

  Examples of prohibited uses	Specific prohibited cases
  Used in visual displays of amusement pay machines, such as on the pinball machine and so on, at shops, amusement facilities or public places.	Used in pachinko (a Japanese upright pinball game), slot machines, arcade games, or Karaoke.
  Used in permanent visual displays at shops or in public places.	Used in information boards at airports, stations and etc.  Used as some kind of visual decoration for a room, window display and show window display in shops and department stores.
  Use a part or all of the materials as a subject of your "Visual Work" to publish or apply for some contests.	By editing and composing with PIXDISC PRO movies as a piece of work to entry and submit to CG contest and other graphic competitions.
  Duplicate a piece of or a series of PIXDISC PRO movies, which purchased with only one number of items, and use them in a classroom to teach motion graphics and graphics.	It is not prohibited, if PIXDISC PRO movies are purchased with the number as many as the student exist in the classroom.
  Used as ID (CI) movies of corporation, brand, broadcasting or others, with their logos.	Used as background visuals of TV station identifications with their logos, which broadcasted between programs. Used as a background of corporate logo in TV commercial.

Extinction of your license

Whenever you have done any of the above prohibited acts or violation of the copyright or other laws related to PIXDISC PRO movies, your license of PIXDISC PRO movies automatically extinguishes.

Warranty

If there are any defects in the product of PIXDISC PRO movies, Pixelcraft co. would like to send a replacement to the purchaser. It warrants if the purchaser claims and returns the item(s) within 30 days after the purchase.
However, no exchange or refund available for any other reasons. For example of that a purchaser does not like the movie no longer or bought mistakenly is not acceptable. Please be forewarned.

Exemption

We don't take any responsibility for the loss or damage caused by the purchaser's use of PIXDISC PRO movies.  Also no refund is going to be made even if there is a payment mistake caused by the purchaser. Please be forewarned.
